C\u2019est ce que la Cour de cassation indique dans un arr\u00eat rendu le 7\u00a0f\u00e9vrier\u00a02024 publi\u00e9 au bulletin.<\/p>\n<\/div>\n<div class=\"gmail-fr-my-4w\">\n<div class=\"gmail-sp-actu gmail-fr-mt-n3w gmail-fr-mb-3w\">\n<div class=\"gmail-fr-mb-4w\">\n<div class=\"gmail-sp-image-container\"><\/div>\n<\/div>\n<p>Un salari\u00e9 saisit la justice contre son employeur. Il demande r\u00e9paration pour manquement \u00e0 l&#8217;obligation de s\u00e9curit\u00e9 r\u00e9sultant du non-respect du temps de repos entre 2\u00a0p\u00e9riodes de travail.<\/p>\n<p>La cour d\u2019appel rejette la demande du salari\u00e9 au motif que celui-ci n&#8217;avait pas rapport\u00e9 la preuve d&#8217;un pr\u00e9judice sp\u00e9cifique en l&#8217;esp\u00e8ce.<\/p>\n<p>La Cour de cassation annule l\u2019arr\u00eat de la cour d\u2019appel et donne droit \u00e0 la demande de r\u00e9paration du salari\u00e9.
