C\u2019est ce que la Cour de cassation indique dans un arr\u00eat rendu le 16\u00a0mai\u00a02024.<\/span><\/strong><\/p>\n<\/div>\n<div class=\"fr-my-4w\">\n<div class=\"sp-actu fr-mt-n3w fr-mb-3w\">\n<div class=\"fr-mb-4w\">\n<div class=\"sp-image-container \"><\/div>\n<\/div>\n<p data-test=\"contenu-texte\">Une association propri\u00e9taire de locaux commerciaux a d\u00e9livr\u00e9 un cong\u00e9 avec refus de renouvellement, avec offre d\u2019indemnit\u00e9 d\u2019\u00e9viction \u00e0 son locataire. Ce dernier saisit le juge afin d\u2019annuler ce cong\u00e9 et d\u2019obtenir l\u2019indemnisation de ses pr\u00e9judices.<\/p>\n<p data-test=\"contenu-texte\">La cour d\u2019appel condamne l\u2019association bailleresse mais limite l&#8217;indemnisation de la locataire aux pr\u00e9judices subis avant la r\u00e9siliation du bail. Elle consid\u00e8re que post\u00e9rieurement \u00e0 cette r\u00e9siliation, la locataire ne pouvait demander pr\u00e9tendre aux droits tir\u00e9s du bail. La locataire se pourvoit en cassation.<\/p>\n<p data-test=\"contenu-texte\">La Cour de cassation casse et annule la d\u00e9cision d\u2019appel.
