Elle conteste devant le juge la rupture du contrat et demande la nullit\u00e9 de la p\u00e9riode d&#8217;essai compte tenu des 3 CDD qu&#8217;elle a pr\u00e9c\u00e9demment ex\u00e9cut\u00e9s.<\/p>\n<p data-test=\"contenu-texte\">La cour d\u2019appel rejette la requ\u00eate de la salari\u00e9e. Pour elle, les 2\u00a0premiers\u00a0CDD (qui ont eu lieu en mai et en juin) ne se trouvent pas dans la continuit\u00e9 du 3<sup>e<\/sup>\u00a0CDD (qui a eu lieu en ao\u00fbt) et du\u00a0CDI conclu ensuite. Il n&#8217;existe donc pas une relation de travail continue entre la salari\u00e9e et son employeur d&#8217;apr\u00e8s la cour d&#8217;appel. Elle consid\u00e8re que l\u2019employeur se trouvait encore dans le d\u00e9lai pour rompre le CDI.<\/p>\n<p data-test=\"contenu-texte\">La Cour de cassation casse et annule la d\u00e9cision rendue par la cour d\u2019appel. Selon elle, la salari\u00e9e a exerc\u00e9 ses fonctions sans aucune discontinuit\u00e9 fonctionnelle. Ainsi, elle avait la\u00a0<strong>m\u00eame relation de travail avec l\u2019employeur<\/strong>\u00a0au cours de ces diff\u00e9rents contrats.<\/p>\n<p data-test=\"contenu-texte\">La\u00a0<strong>dur\u00e9e des 3\u00a0CDD doit donc \u00eatre d\u00e9duite de la p\u00e9riode d\u2019essai<\/strong>\u00a0pr\u00e9vue par le CDI.
